Booking Conditions

The following Booking Conditions together with the general information contained within our website (www.costaholidayrentals.com) form the basis of your contract with COSTA HOLIDAY RENTALS. Please read them carefully as they set out our respective rights and obligations.
In these Booking Conditions, "you" and "your" means all persons named on the booking form (including anyone who is added or substituted at a later date). "We" and "us" means Costa Holiday Rentals. All bookings are made subject to these conditions.

1. Making your Booking
Bookings can be made online via the booking/enquiry form, by telephone or by email.
Once we have received your booking form /enquiry, we will, subject to
Availability, confirm your selected dates, fee to pay to confirm booking and how to pay by emailing a letter of confirmation, this will be sent to the “party leader”. Please check this carefully as soon as you receive it and contact us immediately should any information be incorrect or incomplete as it may not be possible to make changes
later. We regret we cannot accept any liability if we aren’t notified of any inaccuracies in any document within 5 working days of our sending it out.

2. Payment
In order to confirm your stay, a reservation deposit @ 25% of the booking value, (or full payment if booking within 6 weeks of departure) must be paid at the time of booking.
This deposit is non refundable in the event of your cancellation or failure to pay on time as set out below.
The balance of the cost of your stay must be received by us not less than 6 weeks prior to arrival in Spain (or at the time of booking if this date has passed). This date will be shown on the confirmation. If you have not paid in full and on time we reserve the right to treat your booking as cancelled by you. In this case the cancellation charges set out on the Booking Confirmation will apply.

3. Security (Damages) Deposit
Accidents can happen and we would respectfully ask you to replace damaged items with the same or similar. In addition to the Reservation Deposit, you are required to pay a Security Deposit of £150 before the start of your stay - this is at the time of your balance payment). This is to cover the cost of any loss or damage to any items in and/or at the property, or for non return of the keys, or any service charges caused by you or any member of your party; (for example: electrics/plumbing). This will be clearly itemised for you and deducted from the Security Deposit at the end of your stay. If no deductions are required your Security Deposit will of course be refunded in full within 5 working days from the date of departure or At your departure time and return of property keys - if paid in cash. Payment for damage or loss in excess of £150 must be paid direct to us when requested. If you fail to do so, you will be responsible for meeting any legal costs we incur in recovering full payment from you. There will be a charge of £50 to replace lost keys and the subsequent change of locks.

4. Your Contract
A contract between us becomes binding when we despatch our confirmation
Invoice to the party leader. This contract and all matters arising out of it are governed by both United Kingdom and Spanish law and we both agree that any dispute arising out of or in connection with your stay will be dealt with by the Courts of United Kingdom or the Spanish Judicial System depending on the circumstance.

5. The Cost of your stay
The cost of your stay will be confirmed to you via our Booking Request Form and is guaranteed once your reservation deposit is received by us. We do however reserve the right to correct errors in advertised prices and will do so as soon as we become aware of the error.
All rates include PERSONAL “MEET & GREET” SERVICE, ELECTRICITY, GAS, WATER, SATELLITE, LINEN, TOWELS and preparation before arrival. There is a Cleaning Charge (see relevant website property page for pricing) to be paid, this will be included in the booking invoice at the time of booking but we require this fee to be paid in with the guests final payment of their booking fee balance (6 weeks prior to arrival in Spain) as advised during the booking process.
Please note, changes and errors occasionally occur; please check the price of your stay at the time of booking.

6. Changes by you
Should you wish to make any changes to your confirmed booking, you must notify us by email or telephone as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet all requests.

7. Cancellation by you
Should you need to cancel your stay once it has been confirmed, the party leader must immediately advise us in writing via email or telephone contact. Your notice of cancellation will only be effective when we receive it in writing and we have confirmed receipt via email. As we incur costs from the time we confirm your booking and may be unable to re-sell your period of stay depending on when the cancellation has occurred, the cancellation charges will be payable, these charges are dependant on the duration between your cancellation and your proposed arrival. If your booking is cancelled 0 to 2 weeks before your arrival date, 90% of your rental fee will be held. If your booking is cancelled 2 to 4 weeks before your arrival date, 80% of your rental fee will be held. If your booking is cancelled within 4 to 6 weeks before your holiday date, 70% of your rental fee will be held to cover costs, administration, re-advertising and potential loss of letting for the same period. If your booking is cancelled 6-10 weeks before your booking date 100% of your initial 25% deposit will be held. 10 - 15 weeks, you will be charged 80% of your booking deposit. 15 - 20 weeks, 60% of your booking deposit will be held. 20 - 30 weeks, 40% of your booking deposit will be held. Cancellation 30 weeks +, 20% of your booking deposit will be held.

8. Insurance
It is strongly recommended that you take out adequate travel insurance, please read your policy details carefully. It is your responsibility to ensure that the insurance cover you purchase is adequate for your particular needs. Travel insurance can be purchased separately through travel agents and most Insurance Companies. Under no circumstances do 'we' or the property owners take any responsibility for any loss or injury to persons within your party group whilst staying at any of our properties advertised.

9. Changes and Cancellation by us
Occasionally, we have to make changes to and correct errors on our website descriptions and other details both before and after bookings have been confirmed. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so.
If we have to make a significant change to or cancel your booking, we will tell you as soon as possible and endeavour to offer you an alternative should a significant change or cancellation occur. Although this is unlikely to happen, this has to be made note of. If alternative accommodation is required it will be as near as possible to your chosen rental in every way.
Should the accommodation booked become unavailable due to circumstances beyond our control a full refund will be given or alternative accommodation will be offered.
We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation.

10. Special Requests and Medical Problems
If you have any special request, you must advise us at the time of booking and clearly note it in the extra information section of the booking form. Although we will endeavour to meet any reasonable requests we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part. We regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as "standard" bookings subject to the above provisions on special requests.
If you or any member of your party has any medical problem or disability that may affect your stay, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking.
If we reasonably feel unable to properly accommodate the particular needs of the person
Concerned this will be the ‘party leader’s responsibility and we will offer no compensation for any issues/complications that may occur during said persons stay in the property, failure to fore mention said condition/health etc is the ‘party leader’s responsibility.

11. Passports, Visas and Health Requirements
It is your responsibility to ensure that you are in possession of all necessary travel and health documents (including Passports and Visas (where applicable) before departure.
You must pay all costs incurred in obtaining such documentation. If you or any member of your party is not a British citizen or holds a non-British passport, you must check passport and visa requirements with the embassy or Consulate of the country (ies) to or through which you are intending to travel.

12. Prices and Website Accuracy
Please note, the information and prices shown on our website may have changed by the time you come to book your stay. Whilst every effort is made to ensure the accuracy of the website and prices at the time of requesting the booking, regrettably errors do occasionally occur. You must therefore ensure you check all details of your stay (including the price) on your booking acceptance.

13. Arrival and Departure

Access to the Rental will be from 16:30 pm on arrival day and the apartment must be
vacated by NO LATER THAN 10:30 am on the day of departure. Possible variation to these times may only be agreed with us and prior to arrival in Spain.

14. Behaviour
We expect all clients to have consideration for other people in the area of the rental.
If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or is likely to cause danger, upset or distress to any third party or damage to the property, or in any way damage the reputation and/or goodwill of our business (Costa Holiday Rentals), we are entitled without prior notice, to terminate the occupation of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation and we will have no further responsibility toward such persons). No refunds will he made and we will not pay any expenses or costs incurred as a result of the termination.

These booking conditions are written with the purpose of protecting all parties concerned and to help ensure that your stay at your selected holiday rental property is an enjoyable one. If we can assist with any further information, please contact us at info@costaholidayrentals.com .

15. CAR HIRE
Car hire is subject to availability and conditions. Drivers must be aged 28 and over having held a FULL and valid driving licence for more than 2 years. Miss use/damage of the hire vehicle will result in charges being incurred to cover costs to rectify and repair any problems/issues caused by the client. This will be charged accordingly and deducted from the clients security deposit/bond. The vehicle is to be returned in equal condition as it was received by the client.

 

Privacy Policy

• You undertake by using this site that you will only use it in accordance with the conditions stated in this section & you or anyone acting as your agent shall comply with applicable laws & regulations.

• We make the promise that it is our policy to never to sell-on, share or divulge in any other manner, any information about our clients to third parties. We undertake that any information we receive as a result of your use of our website or through communications with us that you may subsequently enter into, will be treated by us as confidential.

• Online links to other services & products advertising on our website may take you to the sites of other companies. Such companies have their own privacy policies for which we have neither input nor consequential liability. It is your sole responsibility to ensure that any company you contact & with whom you communicate operates a privacy policy that is acceptable to you.

• We use reasonable precautions to ensure that both electronically & on paper, your details & information are stored securely & not made available to any unauthorised entity, even to the extent of ensuring that our website is scripted using the latest current secure coding & hosted on a suitably reliable hosting platform with such security switching available & activated.

• Only when required by law & when we believe in good faith that it is necessary to comply with a legally given order to do so, would we provide any client information to such Authorities. Due to the constantly changing nature of many aspects of the realty business, we give no warranty of any kind regarding the site or the current accuracy of information contained therein at any time.

• Whilst anti-virus software is used by our own website & the host server, it is the responsibility of the user to ensure that all precautions against any kind of infection being spread between our site or through their own computer.

• In no event shall Costa Holiday Rentals, its owners or agents be liable for any injury, loss, claim, damage, or any exemplary, punitive, indirect incidental or consequential damages of any kind (including but not limited to lost profits or lost savings) whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with any indirect or direct use of or referral from this site, any failure or delay in the functionality of any component of this site, or any deficiency or failure in provided services.
